Do I need Council Approval for all Residential Building works in NSW?

In NSW, not all building works requires Council Approval. However, many Property Owners run into trouble when they try to sell their property and the Conveyancer drawing up their Contract asks them to declare any unapproved building works.

Unapproved building work may result in the Property Owner having to obtain a retrospective approval (Building Certificate).

Seeking approval for retrospective works can be frustrating, costly and time consuming or even delay bringing your property to the market.

Why use our services:

  • Tradesmen may not always check whether a job is Council approved or requires Council approval. Sometimes, they are just happy to get the job!

  • Planning Controls change from time to time so it is important to obtain updated information. (ie: In 2025, there were 11 versions of this particular Legislation)

  • At times small variations that seems minor can result in unapproved building works.

  • Save on Building Plans: Plan a job so that you meet the criteria (if possible) thereby avoiding seeking Council Approval.

  • Save time: Council Approval can take 90+ days from time of lodgement. Preparing Building Plans can take an additional 90 days.

  • Ensure that you do not go to the unnecessary expense of Building Approval for works that may not require Council Approval.

  • Contact us if you are pressed for time and do not have days or weeks to wait for Council to respond to your enquiry.

  • Remain anonymous & check whether you meet the criteria. ie: (You do not have to provide us with your property address)
